Terms of Service

These Terms of Service ("Terms") govern your use of RecruitScreen, a video pre-screening platform provided by Indxtree Pty Ltd (ABN 22 699 760 113) ("Indxtree", "we", "us"). By creating an account, starting a trial, or subscribing, you agree to these Terms on behalf of yourself and the organisation you represent.

1. The service

RecruitScreen lets recruiters create campaigns, invite candidates to record one-way video responses, and review those responses. We provide the service on a subscription basis and may improve, change, or add features over time.

2. Accounts and eligibility

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your workspace, including your team members. You must be authorised to bind your organisation and be at least 18 years old.

3. Free trial

New workspaces start with a 14-day free trial. At the end of the trial, an active subscription with a valid payment method is required to keep running campaigns. If no payment method is added, your workspace is paused (your data is retained) until you subscribe.

4. Subscriptions, billing and auto-renewal

Paid plans are billed in advance on a monthly or annual basis in Australian dollars. All prices are inclusive of GST. Subscriptions renew automatically for successive periods until cancelled. By subscribing, you authorise us (through our payment processor, Stripe) to charge your payment method for each renewal until you cancel.

If a payment fails, we will retry it and notify you. If payment cannot be collected within the grace period, your workspace will be paused until a valid payment method is provided.

5. Changes to plans and pricing

You may upgrade or downgrade your plan from your workspace; changes are prorated. We may change plan pricing or features; if we increase the price of your plan, we will give you reasonable notice before it applies to your next renewal, and you may cancel before it takes effect.

6. Cancellation

You can cancel at any time from your billing settings. Cancellation takes effect at the end of your current paid period; you keep access until then. See our Refund & Cancellation Policy.

7. Acceptable use

You must not use RecruitScreen to break the law, infringe others' rights, discriminate unlawfully against candidates, upload malicious content, or attempt to disrupt or reverse engineer the service. You are responsible for complying with employment, privacy and anti-discrimination laws that apply to your recruitment activities, and for obtaining any candidate consents required for recording and assessment.

8. Your content and candidate data

You retain ownership of the content you and your candidates submit. You grant us the rights needed to host and process that content to provide the service. You are the controller of candidate personal information; we process it on your behalf as described in our Privacy Policy.

9. Availability and support

We aim to keep the service available and reliable but do not guarantee uninterrupted operation. Support is provided by email at hello@indxtree.com.

10. Consumer guarantees and liability

Nothing in these Terms excludes rights you have under the Australian Consumer Law (ACL) or other laws that cannot be excluded. To the extent permitted by law, our liability for any claim connected with the service is limited to resupplying the service or refunding the fees you paid for the period to which the claim relates, and we are not liable for indirect or consequential loss.

11. Suspension and termination

We may suspend or terminate access if you materially breach these Terms or fail to pay. You may stop using the service at any time by cancelling and closing your workspace.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
